Facilitation for the mining sector – The financial guarantee for exploration permits is reduced, and the transfer of permits is allowed

In the law “On the mining sector”, which provide for the reduction of the value of the financial guarantee, which must be deposited by companies that hold a mining permit for exploration.

Also, the draft law provides for the transfer of permits issued by competitive procedure, which so far has been one of the problems in the development of the mining market. According to the proposed changes, the possibility of transferring permits issued by competitive procedure will be allowed after a period of 5 years from the date of issuance of the permit.

The commission also discussed an amendment, tabled by MP Vullnet Sinaj regarding conflicts arising between mining permit holders and landowners around mining areas, due to the failure to reach a financial agreement.

According to the proposed changes, regarding the extension of the mining permit, it will be done only when the resumption of exploitation does not conflict with other projects of public interest. On the other hand, with the new law, the subjects that hold a career exploitation license for minerals and the group of construction minerals are given the right to temporarily suspend the exploitation activity in the allowed area.
