State pressure compelling judges to deliver against enterprises: Jaka at Civici’s Argument
The public administration pressure is forcing the judges in Albania to take decisions against the business community.
This was the statement that the Chair of the Chamber of Commerce and Industry Tirana Nikolin Jaka made for the show Argument.
Jaka emphasized that according to the information he has judges are making unfair decisions as far as the business community is concerned to escape increasing administrative pressure, while only 20 percent of the cases come from citizens.
“80 percent of court proceedings are generated by the Public Administration. 80 percent of judicial phenomena and practices are generated by the Public Administration and only 20 percent are generated by citizens.”
Jaka has also presented a complete picture of legal conflicts that go to court when it comes to private enterprises.
According to him, the state first creates the conflict and then it seeks the solution in its favor.
“From the information that comes to me, the private enterprise is losing all the trials it has with the state. Most of them, unfairly. Why? Because the judicial system and the judges are under constant pressure from the government, “you get money for every issue”, “we are a state and we have no money to give”, so you are deciding in favor of the entrepreneurship because that uis where you get the Money from. This is the most damaging phenomenon of the economy and the system, because the judges say “It is impossible for us to deliver justice because I’m under state pressure” – “I understand that you are right, but I cannot, because I’m being monitored.” Is this justice?” concluded Jaka.
