Transactions will no longer be direct – Notaries should open special bank accounts where customers will deposit money
Notaries will open special bank accounts to enable transactions between clients or third parties. The Ministry of Justice has issued an Instruction, which stipulates that in order to exercise its activity, the notary opens special bank accounts with commercial banks, in order to perform financial transactions aimed at transferring monetary values to the client’s account or a third party, according to the terms and conditions set out in the notarial deeds drafted by him or her.
The special notary bank account in commercial banks is an “escrow” account and does not generate interest. It is a different account from the bank account that the notary uses as a natural person or as an individual. In the special bank account is deposited only the monetary value intended for the execution of financial transactions for clients or for third parties, which is reflected in each case with a notarial deed drawn up by the parties in the notary office.
